A Davenport, New York man is facing charges following a crash September 9 that left a 13-year-old passenger with a serious head injury.

Delaware County Sheriff’s Deputies responded to a report of a crash on State Highway 23 in the Town of Davenport near Brick House Hill Road on Thursday afternoon.

Responders to the single-vehicle crash say they found a 13-year-old passenger had suffered a serious injury and the teen was airlifted to Albany Medical Center.

The driver, 35-yer-old Robert Smith sustained minor injuries.

Deputies say they determined Smith was traveling east when he fell asleep. The car traveled across the oncoming lane and ran off the road, hitting a tree.

Authorities say they discovered Smith had been driving while his registration was suspended due to an insurance lapse.

Smith is charged with operating with a suspended registration, moving from a lane unsafely and failure to keep right.

The teen’s condition was not available.
