Former Vestal Diner Owner Kept Withheld Payroll Taxes

The former owner of the Vestal Diner will be sentenced in July for failing to pay federal payroll taxes he withheld from his employees’ paychecks for ten years.

57-year-old Nezir “Nick” Boljevic pleaded guilty in federal court to one felony count of willful failure to pay federal payroll taxes.

According to federal prosecutors, Boljevic admitted that, from 2007 to 2017 while he owned the diner off the Vestal Parkway, he failed to make payroll tax payments or report withholdings to the government even though he withheld the taxes from employee paychecks.

Authorities say in order to avoid IRS collection efforts, Boljevic routinely put his business under the names of a series of “nominee owners” with different Employer Identification Numbers for tax purposes but remained the real owner and operator of the Vestal Diner.

He’s expected to be sentenced to a year and a day in prison and have to pay $322,516.51 to the IRS.

The U.S. Attorney’s Office says Boljevic no longer owns or operates the Vestal restaurant.
