Authorities in Tioga County are investigating the shooting death of a man who allegedly had been trespassing inside an unoccupied home.

Investigators say 29-year-old Cody Wagner of Rome, Pennsylvania was shot once in the upper abdomen on Waite Road in the town of Nichols.

Sheriff's office Captain Shawn Nalepa said a man called 911 around 11:40 a.m. Saturday to report he had shot a person.

Nalepa said the man was the caretaker of the residence at 1958 Waite Road. He told investigators he had confronted a man inside the home and was escorting him out.

The caretaker said Wagner went to his parked pickup truck and pulled out a revolver. The caretaker, who was armed with a shotgun, said he fired one shot at Wagner when the man pointed the revolver at him.

A sheriff's deputy and a state trooper tried unsuccessfully to revive Wagner before medics arrived. Wagner was pronounced dead at the scene.

Nalepa said the revolver Wagner possessed had been loaded. He said the investigation is ongoing and no charges have been filed at this time. He declined to release the name of the man who shot Wagner.

An autopsy conducted at Lourdes Hospital in Binghamton ruled Wagner's death a homicide as a result of the gunshot wound.

Tioga County sheriff's investigators and being assisted by the state police Bureau of Criminal Investigation.
