The family of Britney Laserinko is suing 33-year-old Kevin Wilcox of Harpursville and his mother, who owned the jeep involved in the deadly collision, for negligence.

While 16-year-old Harper Stantz died as a result of injuries suffered in the crash, Laserinko is still being treated at a hospital in Syracuse for serious injuries.

Wilcox was arrested following the crash at around 3:30 p.m. March 11 after the girls were hit while walking on the sidewalk on their way home from playing tennis at Recreation Park.

Authorities say Wilcox showed signs of impairment and he reportedly told authorities he had taken prescription Suboxone a half hour prior to the crash.

The lawsuit against Wilcox and his mother was filed in Broome County Supreme Court Friday seeking unspecified damages.

Wilcox has pleaded not guilty to vehicular assault and driving while ability impaired by drugs.
