While just last week a Supreme Court Justice blocked enforcement of Governor Andrew Cuomo’s Executive Order banning flavored vaping products in New York, the State Legislature is moving forward with its own ban.

Last week, Justice Catherine Cholakis said the executive branch should not be regulating e-cigarettes and vaping products and those regulations should be legislated. 

January 13, word came from Albany saying the Democratic Senate Majority plans to pass a ban on flavored vapes as early as next week.

The Legislature has also been debating just how wide-reaching the ban should be.  The Executive Order had covered all flavors except tobacco and menthol.  Other proposals had also included menthol in the ban. A Democrat-sponsored measure in the State Senate would ban all flavored smoking products including menthol-flavored cigarettes, vape liquid and e-cigarettes.

The vaping industry has been fighting the ban, which supporters say is aimed at stopping marketing targeting young people.
