According to the Broome County District Attorney F. Paul Battisti, 38-year-old Joshua J. Smallze of Binghamton, New York, was found guilty of Burglary in the First Degree and Criminal Mischief in the Third Degree by a Broome County Jury on Wednesday, May 1, 2024, in Broome County Court.

The District Attorney's Office noted that Smallze forcefully entered a property at 75 Prospect Street, Binghamton on January 22, 2023, where he assaulted the resident and also caused property damage to the victim’s residence by hurling a brick through an upstairs bedroom window.

Smallze is scheduled to appear back in court for sentencing on August 1, 2024, where he will face a sentence between 5 and 25 years in New York State Prison.

This case was investigated by the Binghamton Police Department, and Deputy District Attorney Lucas Finley prosecuted this case for the District Attorney’s Office.
