Delaware County District Attorney Shawn J. Smith has announced that the Delaware County Grand Jury returned an eight-count indictment against 32-year-old Drew J. Garnier of Masonville, New York.

The charges against Garnier include the murder of Samantha Garnier and the attempted murder of the couple’s two minor children.

Charges Against Drew Garnier

Garnier faces a series of serious charges following an eight-count indictment. These charges include Murder in the Second Degree, which alleges the intentional killing of Samantha Garnier, Drew's wife, carrying a potential sentence of 25 years to life in prison if convicted.

Additionally, Garnier is charged with two counts of Attempted Murder in the Second Degree, each relating to the attempted intentional killing of his minor children, with a potential prison term of up to 25 years upon conviction.

Other charges in the indictment include Criminal Use of a Firearm in the 1st Degree, accusing Garnier of possessing a deadly weapon capable of causing death or serious injury, and multiple counts of Criminal Possession of a Weapon in the Third Degree, involving possession of large capacity ammunition feeding devices, an AK-47 Assault Weapon, and a Tactical ST15 Assault Weapon.

Legal Proceedings

Garnier, arraigned by Delaware County Court Judge John L. Hubbard, pleaded not guilty to all charges. Following arguments from both sides, Judge Hubbard remanded Garnier to the custody of the Delaware County Sheriff’s Office without bail. The case is set for a conference on September 30, 2024.

Chief Assistant District Attorney Richard D. Northrup Jr. presented the case to the Grand Jury. District Attorney Shawn J. Smith acknowledged the New York State Police for their prompt response and thorough investigation.
