Broome County District Attorney F. Paul Battisti announced today that Jamie Viviano, 43, of Binghamton, has been sentenced in Broome County Court for two separate burglary incidents that occurred at a Mather Street apartment complex in 2024. The sentencing took place on June 27, 2025.

Six-Year Sentence for Second-Degree Burglary

Viviano received a sentence of 6 years in New York State prison, followed by 5 years of post-release supervision, after pleading guilty to Burglary in the Second Degree, a class C violent felony. He also received an additional 2⅓ to 7 years for a separate charge of Burglary in the Third Degree, a class D felony. The sentences will run concurrently.

Stolen Coins and a Knife Threat

The charges stem from two incidents at the same apartment building located at 1 Mather Street. On August 5, 2024, Viviano entered the property illegally and stole coins from a washing machine. He returned on December 13, 2024, again targeting the machine, but this time brandished a knife and threatened a staff member on site, significantly escalating the severity of the crime.

This defendant repeatedly violated the safety and security of residents and staff at a residential facility,” said District Attorney F. Paul Battisti. “His conduct escalated from theft to violence, and today’s sentence ensures that he is held accountable.”
