37-year-old Derrick Cervini, who already pleaded not guilty under the first indictment, is also pleading not guilty to nine new felony counts of criminal sexual act and sexual abuse.

The new indictment alleges Cervini forcibly subjected the teen to sexual contact in October of 2014 in the Village of Johnson City.  The indictment charges him with six new sexual act and three new sexual abuse counts.

Cervini is scheduled to go on trial in September.  If convicted in a combined indictment on 19-counts, he faces 25 years in prison.

Co-defendant, 34-year-old Heather Kasmarcik pleaded guilty to charges related to the woman bringing the child into a room with Cervini knowing the teen would be sexually assaulted.

Kasmarcik is scheduled to be sentenced next week to ten years in prison.

The pair was arrested last October.
