A Cortland County man is facing three felony counts following a crash on Route 90 in the Town of Homer.

Sheriff’s Deputies were called to the scene at around 1 p.m. June 6 and found the damaged vehicle in the road and unoccupied.

39 year old Timothy Neilon was located at his home and charged with felony counts of drunk driving, aggravated driving while intoxicated with a child in the vehicle and aggravated unlicensed operation along with traffic infractions of unlicensed operator, leaving the scene of an accident and moving across hazard markings.  Neilon is also charged with misdemeanor endangering the welfare of a child.

Deputies say their investigation revealed Neilon was driving west on Route 90 when he drove off the road and hit an earth embankment.

The child in the car was not hurt and was turned over to family members.

Neilon was sent to the Cortland County Jail on $2,000 bail.
