The latest bid by the legal team for a former Tioga County business man to have his murder charge dismissed again falls short.

Calvin Harris’ lawyers made a motion in Schoharie County Court to have the charge thrown out but the judge denied the motion, saying there was sufficient evidence to pursue a fourth trial.

Harris had been convicted twice of murder in the disappearance of his wife, Michele in 2001.  While no body or weapon has been found, it’s been assumed that Michele was murdered.

The two convictions were overturned and the third trial earlier this year ended in a hung jury.

Harris is scheduled to go on trial for a fourth time on March 2.
