Broome Restaurant Owner Admits Not Paying $59,000 in Taxes

A man who operated a Broome County restaurant has been convicted for failing to pay more than $59,000 in sales tax collected by the business.

Authorities say 52-year-old Robert Niederriter of Kirkwood owned Buffalo Head Bar and Grill in the town of Conklin from 2011 through 2015.

Officials say Niederriter filed only two quarterly sales tax returns when he should have filed eighteen.

Niederriter pleaded guilty to a felony count of grand larceny in Broome County Court. He also has pleaded guilty to a misdemeanor count of petit larceny in Conklin town court.

Investigators determined the business owner underreported sales by more than $747,000.

According to a news release from the New York State Attorney General's Office, Niederriter paid the money that was owed to the tax department as part of a plea deal. He was sentenced to a one-year conditional discharge.

Another business now operates at the location where the Buffalo Head Bar and Grill had been.
